Walmart settlement update: Deadline to claim up to $500 is near

Time to claim part of a $45 million settlement related to the purchase of certain types of food items at Walmart is getting near.

The settlement covers Walmart shoppers who purchased meat, seafood or bagged citrus that was sold by the pound from Oct. 19, 2018 to Jan. 19, 2014. Meat products include beef, chicken, pork, turkey and other meats; seafood includes various types of fish, crab, lobster and more. The settlement also covers bagged citrus, including organic oranges, grapefruit, tangerines and navel oranges sold in bulk in mesh or plastic bags.

According to a 2023 class action lawsuit, Walmart’s point-of-sale machines would artificially raise the weight of the goods when they were marked at a discounted “Rollback” price, meaning the total price would be more than the advertised discount. Also, the suit alleged goods that were nearing expiration date and marked with a yellow sticker were sold at a higher price than the per-unit price indicated.

Walmart has denied the claims.

Under the terms of the settlement, shoppers can receive:

  • $10 – If you bought up to 50 weighted goods and/or bagged citrus but don’t have proof of purchase
  • $15 – If you bought between 51-75 weighted goods and/or bagged citrus but don’t have proof of purchase
  • $20 –  If you bought up to 76-100 weighted goods and/or bagged citrus but don’t have proof of purchase
  • $25 – If you bought 101 weighted goods and/or bagged citrus but don’t have proof of purchase
  • Up to $500 – If you have proof of purchase for each weighted good and/or bagged citrus that was purchased during the settlement period and have the amount you paid for each item, you can receive 2% of the total cost, up to $500.

Claimants may be able to obtain copies of their receipts on Walmart’s website.

The amount of the final payment will depend on how many people opt to participate in the settlement. The deadline to opt out of the settlement is May 22 with an approval hearing set for June 12. The deadline to submit claim forms is June 5.
