Video prompts call for mistrial for Dr. Jonathan Nakhla in death of USA medical student
A new surveillance video from a motel prompted the judge in the Dr. Jonathan Nakhla reckless murder trial to send the jury home early Friday while he considers the new potential evidence, WKRG is reporting.
The video was acquired by investigators from the Comfort Inn near the site where Nakhla’s car crashed, killing 24-year-old University of South Alabama medical student Samantha Thomas. Prosecutors say Nakhla was intoxicated at the time of the crash and was driving in excess of 135 mph.
Defense attorneys told Mobile County Circuit Court Judge Ben Brooks they were only made aware of the video at 6 p.m. Thursday night and motioned for a mistrial. Prosecutors, however, said they did not intend to introduce the video as evidence at trial.
The video purportedly shows a man at the Comfort Inn who is the “other driver” defense attorneys say caused the wreck by cutting in front of Nakhla without a turning signal.
