Shooting death of suspected Birmingham carjacker ruled justifiable

The May shooting death of a 20-year-old man during a Birmingham carjacking has been ruled justifiable.

Birmingham police on Friday said no criminal charges will be filed in the May 18 killing of 20-year-old Patrick Bennett.

East Precinct officers were called to the 700 block of Springville Road just before 8 p.m. that Wednesday on a report of a person shot at the Springville Landing apartments, said Officer Truman Fitzgerald.

Officers found Bennett unresponsive from a gunshot wound. He was pronounced dead on the scene at 8:04 p.m.

Fitzgerald said as a second group of patrol officers headed to the scene, they were flagged about a second person down from gunfire in grassy area, also in the 700 block of Springville Road.

Birmingham Fire and Rescue Service transported the carjacking victim, who was found shot outside an apartment, to UAB Hospital with life-threatening injuries.

The carjacking victim, police said, was on his way home when he was approached by multiple suspects. He was shot, and then returned fire, striking Bennett.

Of the 128 homicides in Birmingham this year, nine have now been ruled justifiable.
