Shooting death of masked man in Birmingham’s Avondale community ruled justified
The shooting death of a masked man in Birmingham’s Avondale community has been ruled justifiable.
Birmingham police on Sunday said no criminal charges will be filed in the June 21 slaying of 34-year-old Rufus Brock.
Brock was killed that Friday in a shootout in the parking lot of Oak Tree Apartments in the 4400 block of Fifth Avenue South. Multiple shots rang out about 11 a.m.
Officer Truman Fitzgerald said it appears Brock and another man – both wearing black nylon masks – were trying to rob someone when shots were exchanged.
Brock was pronounced dead on the scene, still wearing a mask on the ground near the tire of a work truck.
The other man was taken to UAB Hospital where authorities initially said he died, but later said medical staff was able to revive him. There has been no update on his condition.
The robbery victim was also wounded in the shootout. His injuries were not life-threatening.
Fitzgerald said the evidence was presented to the Jefferson County District Attorney’s Office which ruled no charges would be filed.
There have been 75 homicides so far in Birmingham this year. Brock’s death is the eighth to be ruled justifiable.
In all of Jefferson County there have been 98 homicides including the 75 in Birmingham.
