Indicted Walker County deputies allegedly stomped on Tony Mitchell’s genitals while he was handcuffed

Two Walker County sheriff’s deputies have been indicted on federal charges involving the mistreatment and abuse of Tony Mitchell, who later died while in the custody of the jail.

Though 10 former jail employees have agreed to plead guilty to federal charges in connection to Tony Mitchell’s 2023 death, these are the first indictments alleging wrongdoing from Walker County Sheriff’s Office employees assigned outside of the jail.

A federal grand jury issued deprivation of rights indictments last week against Carl Lofton Carpenter and James Matthew “Matt” Handley. They were made public Tuesday.

The indictment does not publicly identify the inmate but the date of the inmate’s arrest and the inmate’s age are the same as Mitchell.

Mitchell was arrested Jan. 12, 2023, during a mental health welfare check at his home. Authorities said he fired a gun while deputies were on his property.

Deputies responded that Thursday afternoon to Lost Creek Road near Carbon Hill on a welfare check after family members of Mitchell feared he could harm himself or someone else.

On the day he was arrested, Mitchell covered himself in black spray paint and claimed to have a “portal to hell.”

Carpenter and Handley reportedly transported Mitchell to the jail.

Documents allege Carpenter “stomped on (the inmate’s) genitals with a shod foot” while the inmate lay face up on the ground, handcuffed behind his back.

The indictment also alleges Carpenter and Handley “rammed” the inmate into the exterior of a patrol vehicle and kicked his legs.

Additionally, Handley is accused of giving false testimony to federal grand jury.

Specifically, the indictment says, Handley testified that the suspect – believed to be Mitchell – walked to the patrol vehicle when, in fact, he was “dragged” to the vehicle.

That came after Carpenter reportedly stomped on Mitchell’s genitals, and Handley testified that Mitchell “chose” not walk upon removal from the patrol vehicle in the jail’s sallyport.

The deputies allegedly omitted information that Mitchell “had been the subject of the force,” which would explain why he had difficultly walking after he was moved from the patrol vehicle.

Sheriff Nick Smith and Carpenter did not immediately respond to a request for comment. Efforts to locate Handley for comment weren’t immediately successful.

Both are set to be arraigned later this month.

Mitchell, 33, died Jan. 26, 2023, at Walker Baptist Medical Center, just over two weeks after his arrest.

Subsequent court documents have detailed the horrific conditions of his time in the jail and death.

The county coroner’s death certificate listed Mitchell’s manner of death as homicide and listed the causes as hypothermia and sepsis “resulting from infected injuries obtained during incarceration and medical neglect.”

When Mitchell arrived at the jail, the documents state, he had difficulty walking or standing on his own. He was disoriented, non-combative, and could not follow instructions.

“His face was painted blue from an unknown substance and officers dressed him in a ‘turtle suit,’ often used for suicidal inmates, over his otherwise nude body.

Mitchell, however, was not put on suicide watched.

Mitchell was held in an area known as BK5, often referred to as the drunk tank.

BK5 was unlike all other cells in the jail, but for observation cell AH3, which had no hole in the floor and was used only for detainees for hours at a time. It did not have a sink, toilet, access to any running water or a raised platform to be used as a bed.

Court records show Mitchell never received any medical evaluation until the morning of his death, two weeks after he was arrested.

In fact, jailers actively denied Mitchell medical access by falsely telling medical staff that Mitchell was too combative to be evaluated “when in truth that was not the case,” documents state.

“Calling (Mitchell) combative was an excuse to mistreat him,’’ documents state. “There was no conduct that could have been committed by (Mitchell) that would have justified the denial of medical access.”

The efforts to deny Mitchell medical and mental health care persisted event though he was frequently expressing severe mental health symptoms such as talking incoherently about “demons” and “portals.”

“He was often covered in feces, which was an indication that he could not care for himself,’’ records state.

Mitchell deteriorated over the course of his incarceration.

“At the time he passed, (Mitchell) was almost always naked, wet, cold, and covered in feces while lying on the cement floor without a mat or blanket,’’ the records state.

By the second week of being jailed, the agreement states, Mitchell was largely listless and mostly unresponsive to questions from officers.

Repeatedly during Mitchell’s incarceration, records show, corrections officers actively chose not help him, and would dismiss his needs by saying, “(Expletive) him, he gets what he gets since he shot at cops, or words to that effect,’’ the document states.

The officers also repeatedly made comments that Mitchell “should have been killed because he shot at deputies rather than being brough to the jail,’’ the document says.

On the morning of January 26, 2023, a nurse repeatedly told jailers that Mitchell urgently needed to be taken to a hospital or he could die.

They did not call an ambulance and instead waited more than three hours before taking him to the hospital in the back of a patrol car.

When he arrived at the hospital, Mitchell’s internal body temperature was reportedly 72 degrees.

Doctors tried for three hours to resuscitate him before he was declared dead at 1:15 pm.

First combined IHOP-Applebee’s restaurant in the nation opening

The first fusion location of two of America’s largest restaurant chains will open soon.

CNN reports the combined Applebee’s-IHOP restaurant will open approximately 35 miles west of San Antonio early next year, marking the first time the company has brought the concept to the United States.

Dine Brands, which owns the two restaurants, announced the plans for the dual-branded restaurant last year.

In a 2024 interview with Nation’s Restaurant News, Dine Brands CEO John Peyton said the hybrid restaurants will have “discrete entrances” that allow guests to flow between Applebee’s and IHOP.

New renderings released on CNN show two distinct parts, with a traditional IHOP interior on one side and an Applebee’s, featuring a large bar with TVs, on the other. Both of the chains’ menus are available on either side, and the restaurants share a kitchen.

The idea, reports CNN, is to maximize revenue with the same footprint of a traditional restaurant. The dual format location will have staff trained to work with menus from both Applebee’s and IHOP.

Detroit Lions’ Terrion Arnold: ‘So much meat on that bone that he don’t even know’

The Detroit Lions lost defensive coordinator Aaron Glenn this offseason as he became the head coach of the New York Jets. The Lions promoted linebackers coach Kelvin Sheppard to defensive coordinator for the 2025 NFL season.

In a season full of injuries for the Detroit defense, the Lions placed seventh in points allowed and 20th in yards allowed among the NFL’s 32 teams in 2024.

Five of Detroit’s defensive starters for their season-opener weren’t around for the Lions’ playoff finale, and defensive end Aidan Hutchinson, defensive tackle Kyle Peko and linebacker Derrick Barnes missed as least 12 games apiece.

But Sheppard pointed to the youthful experience gained by the Detroit defense as he prepares for his first season as a coordinator.

“We have a young nucleus, a young core,” Sheppard said. “But somebody that jumps out at me — a Terrion Arnold. There is so much meat on that bone that he don’t even know.

“He called me a couple days ago, playing around. I said, ‘Where you at?’ ‘Down in Florida.’ I said, ‘You better enjoy it because when you get back the next time you see me, we getting to work, brother.’ And he’s like, ‘Oh, absolutely, Coach! I know how you roll!’”

Arnold joined Detroit from Alabama as the 24th selection in the 2024 NFL Draft. Even though he missed one game, Arnold was among the five rookies who played at least 900 defensive snaps in the 2024 regular season, and he played all 75 in the Lions’ 45-31 loss to the Washington Commanders in the second round of the NFC playoffs on Jan. 18.

In the first four games of the season, Arnold was flagged for defensive pass interference five times, defensive holding twice and a face mask once. In his remaining 13 games, Arnold was penalized three times, and because of a broken jaw suffered by former Auburn standout Carlton Davis, he played the most snaps at cornerback for the Lions this season.

“He’s got the right attitude,” Detroit general manager Brad Holmes said at the NFL Scouting Combine. “Again, he took some lumps early, had some aggressive penalties earlier. Like I said at the end of the season, I did think the water’s kind of calmed kind of halfway through.

“But he’s a very coachable player. He cares, he’s passionate, he’s prideful, so he’s going to do the necessary things. He wants to be a great player, we want him to be a great player, so I have no doubt that he’s going to continue to develop.”

Holmes credited former Alabama standout Deshea Townsend for his role in Arnold’s development as the Lions’ secondary coach.

“I thought Deshea did a great job with him,” Holmes said. “And, you know, I expected no different. But, yeah, I got a lot of excitement for Terrion.”

Longtime agriculture supply store closes doors in Huntsville

A longtime agricultural supply store has closed its doors in Huntsville after more than 90 years of operation.

CT Garvin Feed and Seed was founded in 1934 by CT Garvin, Sr., and has had several downtown Huntsville locations, according to its website. CT Garvin had been in its current location at 2215 Holmes Avenue since the 1990s.

It’s Elkmont location on the corner of Thach and Mooresville roads remains open. The store website is also still taking online orders.

The Garvin family owned the store until 2008 when Thornton Garvin Jr. sold the business to Monica Clark. Her husband, sod farmer Dennis Clark, had been a long-time customer of C.T. Garvin.

The business sells lawn and garden supplies, dog and cat food and supplies, animal health supplies, livestock feed and supplies, fertilizers, herbicides and pesticides, as well as fruits, vegetables and gourd seeds.

There is an online auction for the liquidation of supplies at the Huntsville store. The auction will end March 11, with pickup at the Huntsville store on March 12-13, 9 a.m.-4 p.m.

‘Final inspections’ near for I-565 to Town Madison interchange

Madison is working toward opening the westbound ramp of the I-565 interchange at Town Madison by the end of the month.

The nearly $37 million project, which the city funded through a bond issue, was initially expected to be completed in mid-2024. A series of weather-imposed delays pushed back those estimates, said Samantha Magnuson, communications director for Madison.

Magnuson said the city met last week with state Department of Transportation staff on the construction’s progress, and paving, striping and guardrail work remains to be finished.

“ALDOT will be doing their final inspections soon,” she said. “Within just a few weeks, it will be open to traffic.”

Work to ease westbound traffic’s flow into the mixed use development that’s home to Toyota Field began in November 2022. While the eastbound interchange opened in 2021, westbound drivers must exit I-565 about two miles before Town Madison and pass three signaled intersections.

Also in November 2022, Madison city councilors voted to annex the Publix at Clift Farm, a move that was expected to add over $700,000 in annual tax revenue to help cover the cost, according to AL.com.

The city then issued bonds for the construction project. Madison Mayor Paul Finley said at the time the bonds would cover the cost for the interchange’s final phase, including, “flyover ramps to move westbound traffic safely and efficiently in and out of Toyota Field and Town Madison, along with easier access from Redstone Arsenal Gate 7.”

Paying the cost rather than waiting for state or federal funding, Finley said, ensured the interchange would be built promptly.

Huntsville man charged with murder in Martin Road shooting

A Huntsville man has been arrested and charged with murder following a shooting Monday evening.

Huntsville Police officers arrested Byron Alexander Peterson, 22, in connection with the death of 53-year-old Demetrius Jones.

Officers responded to the shooting after 6 p.m. on Monday at 240 Martin Rd. Upon arrival, they found Jones in the doorway of his apartment with gunshot wounds. He was pronounced dead at the scene, police said.

Major Crimes Unit Investigators determined Peterson and Jones, who lived in the same apartment complex, had an ongoing dispute for several months. On Monday, Peterson went to Jones’ apartment where an argument between the two escalated, leading to the shooting. Peterson was located moments later in a nearby apartment and detained.

A handgun in Jones’ apartment and a handgun in Peterson’s apartment were located and taken from the scene as the investigation continues.
