North Alabama man charged with rape of incapacitated woman
A Gadsden man faces first degree rape charges in DeKalb County following an incident reported in late December.
The DeKalb County Sheriff’s Office said Jose Elisama Francisco-Diego, 21, is currently out on $60,000 bond from the DeKalb County Detention Center, according to court records.
According to Sheriff Nick Welden, county investigators were contacted by Collinsville police following a sexual assault report.
Francisco-Diego was arrested on Dec. 29, 2023.
According to court records, he has been charged with raping a woman who was “incapable of consent by reason of being physically helpless or mentally incapacitated.”
Welden, in a statement, said “crimes of this nature and others will not be tolerated in this county.”
