No charges will be filed in fatal shootout between 2 men at Birmingham apartment building

The death of a man during an exchange of gunfire in the parking lot of a Birmingham apartment complex has been ruled justifiable.

The Jefferson County District Attorney’s Office ruled that no criminal charges will be filed in the June 8 slaying of 42-year-old Demetrius Duante Harris, Birmingham police announced Thursday.

Birmingham police North Precinct officers were dispatched at 11:45 p.m. that Thursday to a small apartment building in the 1600 block of 18th Place North.

They arrived to find Harris in the parking lot suffering from a gunshot wound. He was taken to UAB Hospital.

While officers were on that scene, East Precinct officers received a call of a person shot at a gas station in the 5100 block of Richard Arrington Jr. Boulevard North.

The gunshot victim found there had sustained non-life-threatening injuries. He was taken to the hospital as well.

A short time later, Harris was pronounced dead at UAB Hospital.

Authorities said both men were involved in an argument at the 18th Place North location. They exchanged gunfire and shot each other.

Sgt. LaQuitta Wade said the case is the department’s sixth homicide this year to be ruled justified.

There have been 67 homicides in the city so far in 2023. In additional to the six ruled justified, an officer-involved shooting involving an outside law enforcement agency also turned fatal.
