Murder charges dismissed against Alabama couple in death of infant daughter

Charges have been dismissed against St. Clair County parents in the 2021 death of their infant daughter.

Ashley Jacks, 27, and Joshua Lovechio, 24, were arrested two years ago on felony murder charges.

The investigation began on May 23, 2021, when St. Clair County sheriff’s investigators were notified by the Department of Human Resources that the child had been brought to Children’s of Alabama in Birmingham. The girl died from injuries consistent with child abuse.

No additional details about the child’s injuries or her death were ever made public.

After a lengthy probe, the evidence was presented to a St. Clair County grand jury which issued indictments against Lovechio and Jacks.

The St. Clair County District Attorney’s Office this month filed a motion to dismiss the charges.

Chief Assistant District Attorney Mike Anderton wrote this in his motion: “In preparation for trial, the state of Alabama has determined that sufficient evidence does not exist at this point to support the level of proof required by law for conviction, that being, beyond a reasonable doubt.”

St. Clair County Circuit Judge Billy R. Weathington Jr. granted the dismissal without prejudice, meaning the charges could once again be brought in the future.
