Man indicted in deadly 2021 hit-and-run on Interstate 459
A Tuscaloosa man has been indicted in a 2021 fatal hit-and-run of another man on Interstate 459.
Kenneth Ray Smith II, 21, is charged with criminally negligent homicide, which is a misdemeanor, as well as leaving the scene of an accident resulting in injury or death, failure to provide aid, and failure to file a report with law enforcement, all felonies.
A Jefferson County grand jury issued the indictments against Smith in February. Those indictments were made public this week.
He is charged in the death of 32-year-old Blake Trevor Bailey Jr.
Berry was found dead Sunday, Feb. 7, on the southbound side of I-459 just before the Acton Road exit. The discovery was made about 8:45 a.m.
Berry was found unresponsive about 10 yards off the roadway and pronounced dead on the scene.
Authorities said a passing motorist spotted the body of the Hoover man and called 911.
The deadly crash was investigated by the Alabama Law Enforcement Agency. Troopers at the time said they were searching for a gold vehicle is possibly a Toyota Camry or Avalon manufactured between 2007 and 2009.
Smith was initially arrest in June of 2021. He remains out on bond.
A court date has not yet been set.
Berry was a graduate Oak Mountain High School. He worked as an independent contractor in residential remodeling, with dreams of one day starting his own construction business, according to his obituary.
He enjoyed hunting, working on his truck, getting fit and listening to country music.
“He had a heart-warming smile and the most stunning blue eyes. He never met a stranger and would give you the shirt off his back,’’ his obituary read. “Above all else, he loved his daughter and his family with all of his heart.”
