Ice cream settlement: Deadline for $8.5 million settlement is near, covers purchases in last 8 years

The deadline to claim part of an $8.5 million settlement related to a popular brand of ice cream is this month.

The settlement is related to Breyers Natural Vanilla Ice CreamIt comes after a class action lawsuit filed last year that alleged the company advertised the ice cream as containing “vanilla” from a vanilla plant when in fact it had flavors from non-vanilla plants. Breyer’s parent company Unilever and its advertising firm denied the allegations but agreed to the settlement.

The settlement covers anyone who purchased any size of Breyer Natural Vanilla ice cream from April 21, 2016 through Aug. 14, 2024. Sizes covered under the settlement include 1.5 quart, 16-ounce carton and 10 pack of 3-oz. cups.

There are two different payment types:

  • If you have proof of purchase of your products you can be reimbursed $1 per item with no limit
  • If you don’t have proof of purchase, you can receive $1 per item for a maximum of 8 items

There is a limit of one claim form per household. If the total value of claims exceeds the settlement amount after all fees are paid, payments will be divided equally.
