Huntsville woman, charged with drowning toddler, faces death penalty
A Huntsville woman, charged with drowning her 2-year-old daughter in a bathtub, is now facing the death penalty.
Prosecutors on Wednesday filed notice of intention to seek the death penalty against Luccuina Braithwaite, 25, of Huntsville. According to a police affidavit, Braithwaite on July 27 forced the drowning of her daughter in a bathtub filled with cold water and olive oil.

She was arrested the next day after officers responded to a welfare check call about 11 a.m. and found the child floating in the bathtub. Braithwaite ran after officers attempted to detain her and was captured after a short pursuit.
The Madison County district attorney’s office, through Chief Trial Attorney Tim Douthit, filed the one-sentence notice informing the court of the intent to seek the death penalty for Braithwaite.
At a preliminary hearing last month, Madison County District Judge Charles Langham ruled there was enough evidence against Braithwaite to send the case to the grand jury.
In an order issued Tuesday, District Judge Patrick Tuten ordered that prosecutors express their intent on the death penalty by Nov. 30. Douthit filed the prosecutor’s response the next day.
Braithwaite, through her court-appointed attorney Ron Smith, has asked for speedy trial.
