Former Jefferson County deputy whose 11-month-old daughter was killed pleads guilty to gun charge
The parents of an 11-month-old girl killed in a 2021 shooting at the family’s apartment have pleaded guilty to federal gun charges.
Former Jefferson County sheriff’s Deputy Somer Lemere Ross, 27, pleaded guilty Tuesday to twice providing a Taurus 9mm to her fiancé, 30-year-old Robert Elijah Allen, according to federal court records.
It has not been stated whether the gun was used to kill her daughter.
She faces up to a maximum of 10 years in prison.
Allen pleaded guilty to two counts of possessing a firearm as a convicted felon.
Allen and Ross were indicted earlier this year.
The couple’s daughter, Rylee Allen, was killed July 20, 2021, in a shooting at the family’s Birmingham apartment.
No one has ever been charged in Rylee’s death.
According to Ross’s plea agreement, she and Allen on June 5, 2020, walked into the Birmingham Police Department’s North Precinct and reported they were involved in a drive-by shooting.
The told police a vehicle drove up beside them and started shooting. Allen said he exited his vehicle and returned fire. He was able to identify the alleged shooter as a family member’s boyfriend.
Allen then turned over to police the gun he used to return fire, which was a Taurus 9 mm.
A trace of the weapon showed that it was bought by Ross on Feb. 19, 2020, from Quik Pawn Shop in Midfield, records show. Police returned the gun to Ross on Dec. 17, 2020.
On July 20, 2021, Birmingham police responded to a shooting at The Branch at Carson Springs on Carson Road on a report of a person shot.
When officers arrived, they found Rylee dead from a gunshot wound to the eye.
Ross was a deputy at the time her daughter was killed. She had graduated from the sheriff’s academy three months earlier and was assigned to the jail.
In 2021 court records, Allen was described as a “suspect” in Rylee’s death.
Police at the time said they received more than one call about a domestic disturbance taking place in the couple’s apartment.
Both parents were questioned by Birmingham police investigators at that time and were released without being charged with any crime in connection with Rylee’s death.
As part of the homicide investigation, officers found inside the apartment the Taurus 9mm that Allen had previously turned into police and that had been later returned to Ross.
Ross resigned from the sheriff’s office following the death of her daughter and later went to work briefly at the Midfield Police Department before leaving there.
In an unrelated incident, Ross was arrested last year for impersonating a police officer, as well as on other charges stemming from a drug investigation. She was also charged with hindering prosecution, attempting to elude and menacing.
Court record show she pleaded guilty to menacing and received a 12-month suspended sentence. The rest of the charges were dismissed.
On Feb. 28, 2023, Birmingham police sought and obtained a search warrant for Allen’s two cell phones that had been collected from a June 24 traffic stop.
A search of Allen’s phone showed a text conversation between Allen and Ross on April 17, 2020, during which they discussed Allen’s status as a convicted felon. That discussion centered around Allen’s employment application for a store, which authorities said proved Ross knew Allen had been previously convicted of a felony.
A sentencing date for Ross has not yet been announced. Allen’s sentencing is set for Jan. 23, 2024.
