Fight over poached goose leads to man getting shot in Tuscaloosa County, records state

The shooting death of a Canada Goose in west Alabama led to more gunfire, an injury, and criminal charges.

Tuscaloosa County sheriff’s deputies were called at 5:24 p.m. Saturday to a report of a person shot in the 14000 block of Ridge Road in Brookwood.

They arrived to find Colby Lee Pinegar with a gunshot wound, according to court records.

Pinegar was taken to UAB Hospital with non-life-threatening injuries.

The victim told authorities he was inside his home when heard a gunshot. He went outside and saw a man running through the field across the street from his residence.

The suspect, he said, was heading toward a truck carrying a rifle. He could also see the dead goose in the field.

Pinegar and a witness went to confront the suspect. A verbal altercation ensued, and Pineger tried to get the truck’s license plate number, records state.

The truck then began to pull off. As it did, 42-year-old Jacob Wayne Battle leaned out of the window and fired at Pinegar, hitting him at least once in the leg.

When investigators spoke with Battle, he told them he told his son to shoot the goose. The victim and the witness, Battle said, then drove over to confront him.

Battle said he did not see either of the men armed but said when one of the men went to the back of the truck, he did not know what he was going to do so he fired two to three warning shots toward the ground.

The Canada Goose is federally protected.

Battle is charged with first-degree assault, which is a felony. He was booked into the Tuscaloosa County Jail Sunday and released Monday after posting $30,000 bond.
