Fatal shooting of 44-year-old man in Birmingham ruled justifiable; no charges will be filed

The May shooting death of a 44-year-old man has been ruled justifiable and no criminal charges will be filed.

Adrian Dewayne Christian, 44, was killed May 5.

Birmingham police received a 911 call at 11:45 p.m. that Friday reporting a person with a gun in the 1100 block of Fifth Street, off Arkadelphia Road.

A second call then came in that a person had been shot at that same location, said Officer Truman Fitzgerald.

West Precinct officers arrived and found Christian unresponsive in the roadway. Birmingham Fire and Rescue pronounced him dead on the scene.

Fitzgerald in May said the preliminary investigation indicated the unidentified suspect was walking in the neighborhood with a gun. The victim exited a residence and made contact with the armed man.

That’s when Christian was shot.

It appears the two men knew each other, and the shooting was not random.

The man who fired the fatal shots was interviewed and booked into the Birmingham City Jail on a 48-hour felony hold and then released.

On Friday, Fitzgerald said, the Jefferson County District Attorney’s Office determined no criminal charges would be filed.

Birmingham has had 78 homicides this year. Christian’s death is the seventh to be ruled justifiable.
