Homeland Security Secretary Kristi Noem was ripped by Democrats after she incorrectly defined habeas corpus while giving congressional testimony Tuesday.

Noem, the former South Dakota governor who is referred by Democratic social media influencers as “ICE Barbie” over her penchant for photo-ops, was asked “what is habeas corpus?” by Sen. Maggie Hassan, D-N.H., as she testified before the Senate Homeland Security & Government Affairs Committee.

“Well, habeas corpus is a constitutional right the president has to be able to remove people from this country,” Noem said.

Hassan interrupted the secretary to give the correct definition.

“No, let me stop you … habeas corpus is the legal principle that requires that the government provide a public reason for detaining and imprisoning people,” the senator said.

“If not for that protection, the government could simply arrest people, including American citizens, and hold them indefinitely for no reason,” Hassan continued.

“Habeas corpus is the foundational right that separates free societies like America from police states like North Korea,” she said. “As a senator from the Live Free or Die State, this matters a lot to me and my constituents and to all Americans …”

Habeas corpus has been thrust into the national immigration debate after Stephen Miller, a top adviser to President Donald Trump, said earlier this month the administration was debating suspending the constitutional right to expedite deportations.

Asked if she supports the core protection that habeas corpus provides, Noem said: “I support habeas corpus. I also recognize that the president of the United States also has authority under the Constitution to decide if it should be suspended or not.”

“It has never been done without approval of Congress,” Hassan said. “Even Abraham Lincoln got retroactive approval from Congress.”

Noem’s response was slammed by Democrats on social media.

“It’s no surprise they are violating court orders when they don’t know the law themselves,” tweeted Jessica Tarlov, co-host of Fox News’ “The Five.”

“ICE Barbie is a f—— idiot,” tweeted Joanne Carducci, a Democratic social media influencer known as “JoJo from Jerz.”

“Kristi Noem doesn’t know what habeas corpus is because understanding it doesn’t come with a cute cosplay get-up,” she added.

Jon Favreau, former head speechwriter for Barack Obama and co-host of the podcast “Pod Save America,” described Noem as having a “fully cooked propaganda brain.”
