Decatur police say man whose Walmart arrest was caught on video had warrant, injured officer

Decatur police say a video circulating on social media shows an officer attempting to arrest a man with an active warrant who injured him.

According to police, the incident took place on Dec. 8 at about 4 p.m. in the Walmart parking lot at 2800 Spring Ave. S.W.

A uniformed, off-duty Decatur police officer, who was working a security detail at the store, attempted to arrest Marquez Daniel Lewis, 29, of Decatur.

Lewis had an arrest warrant through the Morgan County Sheriff’s Office for failure to pay child support.

In a statement, police said Lewis sat in the driver’s seat of a car and refused to get out after the officer requested him to exit the vehicle. The officer then broke the window and a fight ensued, with Lewis “actively” resisting arrest, police said.

“During the initial encounter, and prior to the beginning of the video that has been circulating online, the officer suffered a fractured orbital bone after he was punched by Lewis,” police said in a statement.

Lewis’ mother, Tonda Rochelle Lewis, then began filming the altercation with a cell phone and moved to within a few feet of the incident.

“After ordering her to back up, the officer pushed her back and knocked the cell phone out of her hand,” police stated.

In a video of the incident, the officer can be seen struggling with Marquez outside the vehicle before another officer arrives, when Lewis was taken into custody.

Marquez Lewis was charged with second degree assault, resisting arrest, attempting to flee and elude, and third degree criminal mischief. He was booked into the Morgan County Jail on a $15,900 bond.

Tonda Rochelle Lewis was faces a charge of obstruction of governmental operations. She was booked into the Morgan County Jail on a $300 bond.

The injured officer, whose name was not released, is currently on paid leave while he recuperates.

“An arrest warrant is a command by a judge for an officer to arrest someone,” Police Chief Todd Pinion said. “A person who is told by a police officer they are under arrest has an obligation under the law to submit to the arrest. While we will look at all aspects of the arrest to determine if the officer followed policy and training, what is clear is that a person’s refusal to submit to a lawful arrest resulted in more severe criminal charges and an officer being injured.

“If you believe an arrest by an officer is not valid, submit to the arrest and take legal action after. Resisting arrest creates a great danger to everyone involved and is illegal. And while anyone can record a police officer in public, they cannot do it in a way that interferes with the officer or jeopardizes their safety,” he said.

The incident occurred one day after three Decatur police officers were fired and a fourth suspended for their involvement in the shooting death of Stephen Perkins.

Perkins, a 39-year-old husband, father and gym enthusiast, died after a Decatur officer shot him in the front yard of his home on Sept. 29.
