Damien McDaniel’s lawyer not surprised by new charges, urges public to reserve judgment

The attorney for the 22-year-old Fairfield man charged in Alabama’s deadliest crime spree in recent memory said the defense team was aware more charges could be brought against Damien McDaniel.

McDaniel, charged with killing 14 people and wounding 30 others over a span of 14 months, has maintained his innocence to his lawyers and is innocent until proven guilty in court, said attorney John Robbins.

“I hope that everyone in the community who follows these cases will remember that Damien has not been convicted of any killing or shooting; that not one shred of evidence has been presented in court to support these charges; and that Damien stands before the court presumed to be innocent,’’ Robbins said. “Let’s keep that in mind as we go forward.”

Birmingham police on Tuesday announced McDaniel is now charged in the following homicides:

  • The 2023 shooting death of Firefighter Jordan Melton at Station 9
  • The Jan. 10, 2024, fatal shooting of 21-year-old Mia Nickson outside her family’s home in east Birmingham
  • The April 9 2024, ambush killing of 44-year-old Anthony Lamar Love Jr., a husband and father who had worked at UPS for around 20 years.

“We were aware that there were further investigations going on that were separate from the pending cases,’’ Robbins said. “So, we are not too surprised by the additional charges.”

Robbins said attorneys for McDaniel will not be deterred from providing McDaniel with a vigorous defense that the system of justice demands.

“The defense team understands and appreciates the pain and suffering that the family and friends of all the victims have experienced and will continue to experience as these cases play out in court,’’ he said. “We are not blind to that aspect of any homicide case.”

“We will conduct the defense in a professional and ethical manner, but the whole team will do their best to provide our client with effective representation as lead counsel,’’ he said.

McDaniel, who is accused of multiple murders for hire, is also accused of killing four people each in two separate mass shootings in 2024.

His alleged victims also include 61-year-old man in his home, a young woman shot in a bar two nights before the Five Points South mass shooting and a young man gunned down in the street the next night.

Robbins previously said McDaniel has told him he’s not guilty.

“When I met with him, he said he’s not guilty,’’ Robbins said following a court hearing January.

“We didn’t get into any specifics about the case because I don’t know anything other than the charges and there’s a lot of charges.”

Robbins said then he was eager to see the state’s evidence against McDaniel.

“I know there’s a lot of pressure in the community to prosecute this case,’’ he said. “The actual event was horrific, and we feel for the victims and their families. We understand they want someone prosecuted.”

“If you sit down and talk to (McDaniel), he’s a very gentle, kind person,’’ Robbins said.

“The Damien that I first met, and granted I’ve only met him in this case, but that Damien doesn’t fit the mold of someone who would do these types of crimes.”
