Chick-fil-A $4.4 million settlement: Claim deadline is this week

Time is running out to claim part of a $4.4 million settlement related to Chick-fil-A delivery charges.

But time isn’t the only restriction to claim a gift card up to $29 – the money is only going to people who placed orders in five states.

The settlement came after a class action lawsuit filed in Georgia that alleged the restaurant chain advertised free or low-cost delivery but then recouped the money by raising its food prices for delivery orders. Some of the increases were as much as 30%, the suit alleged.

“In other words, the identical order of a 30-count chicken nuggets costs approximately $5-6 more when ordered for delivery than when ordered via the same mobile app for pickup, or when ordered in-store,” the suit claimed.

Customers were not informed of the markup, according to the claims.

Chick-fil-A did not admit fault in the case but agreed to set aside $1.45 million in cash and $2.95 million in gift cards to settle the claims. The mega-popular chicken chain will also add disclosure notices on its app and website stating buyers may pay more for delivery orders.

Class members can choose between a $29.96 payment or a $29.95 gift card, with final amounts depending on how many are included in the settlement.

To be eligible, you must have placed a delivery order through the Chick-fil-A One App or website between Nov. 1, 2019 and April 30, 2021 from a Chick-fil-A location in California, Florida, Georgia, New Jersey or New York.
