2nd suspect charged with capital murder in 2022 slaying of 3-year-old boy in Montgomery

A second suspect has been charged in a 2022 Montgomery shooting that left a 3-year-old boy dead.

Montgomery police on Monday announced the arrest of 27-year-old Kourtney Tyrone Brisker.

Brisker, taken into custody May 1, is charged with three counts of capital murder in the killing of Ja’Seyon Green.

He is charged with capital murder of a child under the age of 14, capital murder for shooting from a vehicle and capital murder for shooting into a vehicle.

The deadly shooting happened about 3 p.m. on Feb. 11, 2022, in the 400 block of North Decatur Street.

Ja’Seyon was in the backseat of a Hyundai Tucson that was being followed by the suspects who were in a Yukon. Court documents state Brisker fired an AR-15 rifle into the Hyundai, hitting Ja’Seyon, who died a short time later at the hospital.

The first suspect, 26-year-old Jerome William Pettiway, was arrested a month after Ja’Seyon’s slaying. His trial is set for August.

Ja’Seyon’s mother, Kemyasha Green, in 2022 called it the “worst day of my life.”

“We want justice for my baby boy,’’ Green wrote in a GoFundMe that raised more than $10,000.

Class 5A quarterfinals: Elberta holds off Marbury

Elberta High School is heading to the state baseball semifinals for the first time in school history.

The Warriors let a 5-0, seventh-inning lead slip away Monday afternoon but responded with three runs in the top of the ninth and eliminated homestanding and No. 10 Marbury 8-6 in Game 3 of their best-of-3 Class 5A series.

The two teams split the first two games on Friday before weather postponed Saturday’s scheduled Game 3 until today. Elberta (26-8) will host No. 4 St. Paul’s in the semifinals later this week.

“It feels great,” Elberta coach Owen Davis said. “I’m proud for these kids. They’ve played really well and worked their butts off to get here. I’m happy I get to be around them for at least another week and, hopefully, two more weeks.”

The Warriors took the lead for good in the 9th, breaking a 5-5 tie when Adan Ramey scored on a wild pitch. Roman Lochrico’s 2-run single made it 8-5. Marbury trimmed the deficit to 8-6 in the bottom of the inning and had the bases loaded, but Kevin Jones induced a game-ending ground out.

Jones got the win with 2.1 innings of relief. He allowed 1 hit and 1 run and struck out 4. He also walked 4. He took over for starter Landen Adams, who allowed Marbury just 1 hit through six innings but ran into trouble with a 5-0 lead in the bottom of the seventh. The Bulldogs cut into the lead on Benton Howell’s RBI single. An error in the outfield allowed 2 more runs to score. Then, down to his final strike, Carson Mills doubled in 2 runs to tie the game at 5-5.

“I have to give credit to coach (Kevin) Hall and his staff and players,” Davis said. “They didn’t quit but fortunately neither did our kids. Up five runs in the bottom of the seventh, you feel pretty good, but Marbury just kept coming and gave us a run for our money.”

Elberta had taken a 3-0 lead in the top of the second and increased the margin to 5-0 in the fourth. Ramey, Jones and Lochrico each had 2 hits for the Warriors. Lochrico drove in 3 runs. Howell drove in 3 runs for Marbury. Mills was 2-for-2 with 2 RBIs and a pair of walks.

Keon Sampley, the third of four Marbury pitchers, took the loss. The Bulldogs finished 29-8.

Any Alabama fans here? Jury selection begins in Michael Davis capital murder trial

Who here is an Alabama fan?

That’s what the prosecutor asked the crowd that showed up for jury duty Monday in downtown Tuscaloosa. And almost everyone raised their hands.

“Majority of us,” said Paula Whitley, the chief assistant district attorney, as she surveyed the room and tried counting.

The capital murder trial of Michael Davis got underway on Monday as prosecutors and defense attorneys began the process of selecting a jury.

Davis is charged in the death of Jamea Harris, who was shot and killed near the Strip in Tuscaloosa on Jan. 15, 2023. Also charged with capital murder is Davis’ friend Darius Miles, who was on the Alabama men’s basketball team at the time.

That’s why 70 people who got called in for jury duty were questioned about Alabama athletics and Alabama basketball.

Davis fired into a Jeep that carried Harris, her cousin and her boyfriend, Cedric Johnson. A police investigator in 2023 testified that both Davis and Johnson fired their guns early that morning near the Strip. According to police, Davis fired first and hit Harris.

John Robbins, attorney for Davis, has argued that Johnson shot first and Davis returned fire “acting in self defense.” Davis was shot in the shoulder and injured. The gun belonged to Miles, per police testimony; Mary Turner, Miles’ attorney, has stated in court that Miles provided the gun to Davis for protection.

The trial will resume Tuesday as the juror selection process remains ongoing. The trial is expected to go at least until the end of the week.

Miles, who was removed from the team after his arrest, is not on trial this week, and he does not yet have a trial date set.

But, other former Alabama basketball players are on the list of witnesses who could be called to testify during Davis’ trial this week.

Because the case got so much media attention, it’s expected to be difficult to select the 12 people who will ultimately decide the case. Judge Daniel Pruet said the pool of 70 is twice the size of the typical pool for a murder trial in Tuscaloosa County.

Miller and Bradley are former Alabama basketball players who could be called to testify. Miller now plays for the Charlotte Hornets in the NBA, and Bradley transferred to Arizona the season after the shooting.

Neither Miller nor Bradley have been charged with a crime. Both were on the Strip in Tuscaloosa the night Harris died.

If Miller or Bradley came into the courtroom as witnesses, would anyone have problems putting their celebrity aside?

Davis’ defense attorney also brought up Alabama basketball and the former players during his turn to ask jurors questions. Robbins mentioned the Jan. 14, 2023 Alabama vs. LSU game that took place at Coleman Coliseum just hours before the shooting. Robbins asked if anyone in the room was at that game. Robbins even mentioned Miller’s scoring that night: 31 points.

“I do remember that game,” one potential juror said after Robbins jogged his memory.

Met Gala pays tribute to Black fashion and designers and includes Rihanna pregnancy surprise

NEW YORK (AP) — Let the year’s biggest fashion party begin! A rainy Met Gala on Monday included a Rihanna pregnancy announcement, a tuxedoed choir and a trend true to the menswear theme: Emma Chamberlain, Zendaya, Teyana Taylor and many other women in pinstripes and other traditional men’s detailing.

Chamberlain and Zuri Hall were among those who wore sleek, sexy gowns that play on men’s suiting in pinstripes as they walked up the grand steps of the Metropolitan Museum of Art. Zendaya, a co-host last year, wore a perfectly tailored white trouser suit with a matching wide-brim hat from Louis Vuitton,

The menswear vibe for women was frequent and expected, “women wanting to maintain a traditionally feminine dress silhouette while still respecting the theme,” said William Dingle, director of style for blackmenswear.com, a cultural impact agency that focuses on uplifting Black men.

Doja Cat, always fearless when it comes to fashion, donned a Marc Jacobs bodysuit look with orange and black wildcat detailing and broad-shouldered pinstripes. Taylor went for a stunning Zoot Suit look with a red, feather-adorned top hat and a huge matching cape dripping with flowers and bling. She collaborated with famed costumer designer Ruth E. Carter.

The Zoot was popularized in Harlem in the 1940s.

And then there were the bombshells …

Megan Thee Stallion in Michael Kors and Dua Lipa in black Chanel included. Megan’s look had a high side slit and floral lace embellishment. Lipa was giving elevated flapper in feathers and an “S” curl style for her hair. And Miley Cyrus oozed womanhood in a custom cropped black crocodile jacket and long black taffeta skirt by Alaïa.

Diana Ross, meanwhile, swallowed the carpet in a huge white train, escorted by her son, Evan Ross.

The standouts among the men

As for the men, co-host A$AP Rocky told The Associated Press that Anna Wintour suggested he wear a Black designer.

“So I wore myself,” the musician said of his custom suit designed by his creative agency, AWGE, complete with a black parka and diamond-crested umbrella. “Everything is designed by yours truly.”

Rocky, Rihanna’s partner and dad to their two kids, confirmed to reporters that baby No. 3 in on the way. He spoke about it after Rihanna was photographed walking in the rain with her baby bump out in a blue crop top and skirt.

“It feels amazing, you know,” Rocky said. “It’s time that we show the people what we was cooking up. And I’m glad everybody’s happy for us ‘cause we definitely happy, you know.”

He added: “Honestly, it’s a blessing nonetheless. Because you know how like some people in other situations at times can be envious of other people. But we’ve been seeing love for the most part. And we real receptive to that and appreciate that, you know what I mean? That’s love. Love is love.”

The dress code explained

What, exactly, was the suggested dress code of the night, “Tailored for You,” is inspired by Black dandyism. And what, exactly, is the Met Gala for? To raise money for the Met’s Costume Institute. The gala raised a record $31 million before it began.

More on the men

Colman Domingo, one of the evening’s hosts, wore a pleated, gold adorned cape over a gray and black suit, his jacket a pearled windowpane design with a huge dotted black flower. His look, including his cape and a dotted black scarf at his neck, evoked the late André Leon Talley, the fashion icon who made history as a rare Black editor at Vogue.

Domingo, in Valentino, arrived with Vogue’s Wintour, dressed in a pastel blue coat over a shimmery white gown by Louis Vuitton, a gala sponsor. Fellow co-chair Lewis Hamilton donned a jaunty ivory tuxedo with a cropped jacket and matching beret.

Colman has epitomized contemporary dandyism in a variety of looks over the years.

Pharrell Williams, another co-host, was demure in a double-breasted, beaded evening jacket and dark trousers. He kept his dark shades on while posing for the cameras. Williams walked with his wife, Helen Lasichanh, in a black bodysuit and matching jacket.

Williams, the Louis Vuitton menswear creative director, said his 15,000 pearls were arranged in a pinstripe design and the jacket took 400 hours to construct.

Walton Goggins, a guest this year with others from “The White Lotus,” wore a deconstructed suit look with seams out and a pleated skirt he twirled for the cameras.

LeBron James, the NBA superstar, was named honorary chair of the evening but bowed out at the last minute due to a knee injury.

Other Met Gala looks that stood out

Monica L. Miller, whose book inspired the evening, wore a bejeweled cropped cape over a dress adorned with cowrie shells by Grace Wales Bonner. It’s a direct connection to a piece in the gala’s companion Metropolitan Museum of Art spring exhibit that Miller guest curated.

What other women killed the menswear game? Coco Jones in an ivory tuxedo coat with a train over matching trousers, both covered in chunky embellishment.

“Coco Jones absolutely leaned in,” Dingle said. “I love the pearl and gem embellishments here, as well as the long coat, and even the necklace. Because she’s taller, the long coat even further elongates her legs. This is a fantastic look.”

Her look was by Indian designer Manish Malhotra. She said she wanted to honor Black excellence by going all out.

Sarah Snook of “Succession” fame and fresh off a Tony nomination for “The Picture of Dorian Gray,” was successfully on theme as well.

“She’s in a two-button, double-breasted jacket fashioned into a tailcoat-like train in satin fabric for luster, plus crimson lining for a pop of color,” Dingle said. “I like the multiple brooches on the wide lapel.”

Gigi Hadid, on the other hand, went all woman. She pulled up the spirit of Josephine Baker in a shimmery gold halter gown by Miu Miu that hugged her hips.

Bad Bunny, ever a fashion rebel, wore a custom black Prada suit. The best detail: his woven hat, which appeared to be a reference to the pava, a straw hat associated with the Puerto Rican jíbaro.

Huntsville orders work to stop on Monte Sano development after flooding

The city of Huntsville has ordered construction of a subdivision on Monte Sano Mountain to stop until required drainage infrastructure is in place.

The action came after stormwater runoff from the Summit at Monte Sano development flooded the adjacent Heritage at Monte Sano subdivision on Gaslight Way on the mountain this past weekend.

“The city of Huntsville’s engineering staff met this morning and made a site visit to the development,” said City Director of Urban and Economic Development Shane Davis. “Upon review of the site, the engineering department issued a limited stop work order on the project.”

The “limited” stop work order directs the contractor to only work on completing the ongoing stormwater drainage construction portions of the development prior to advancing additional activities, Davis said in a statement to AL.com.

“The city wants us to focus on a berm that was to be installed at the very end of the project,” said See Forever Managing Partner Ben Jackson. “They now want that installed now. We will be working on the berm.”

Davis said the engineering staff was able to download storm data for the area (rain gauge and intensity data) from the weekend’s rains and said the storm exceeded a 100 – year storm event and definitely contributed to the amount of runoff.

Jackson maintains work on the development is not to blame for the flooding, but residents in the neighborhood dispute the claim.

In his complaint with the city, Gaslight Way resident Mark Judge said storm runoff from the Summit at Monte Sano “is causing erosion damage to existing property of owners in the Heritage of Monte Sano.”

He said the runoff continues to cause damage and cleanup issues even though countermeasures have been put into place.

“With the storm drainage infrastructure compete on the southern end of the development, I do not see this getting better, actually worse, once the construction of houses start,” Judge said.

He said erosion from the storm runoff is an issue every time it rains and not just from a 100-year event.

Michael Stephenson posted a video on YouTube of the flooding:

“The Summit development in Huntsville is recklessly and carelessly eroding Monte Sano mountain, including Oak Park trail on land trust property, and onto my home property on Oakwood Ave,” he said in his description. “This video starts at the bottom on Oakwood and walks all the way to the source of the red clay river … the ungoverned water cannons blasting down the mountain from the Summit development. It ends back on Oakwood.”

But Jackson said the runoff “did not just come off of our property.”

“It came from above as well, ran through our drainage system, into these lower neighborhoods that were not required to have these advanced draining systems in place,” he said.

Nonetheless, Davis said, “the developer/contractor must complete all drainage work and complete construction (currently ongoing) of the development retention ponds and drainage swales.”

Alabama Gov. Kay Ivey increases state budgets, signs landmark school funding reform package

Alabama is increasing its state spending with higher education and general fund budgets, which Gov. Kay Ivey signed into law Monday.

In an announcement Monday, Ivey praised lawmakers for increasing investments in literacy and numeracy efforts, as well as nearly doubling funding for the CHOOSE Act, a new program that gives families tax credits to spend on private education.

“These historic investments in core functions of government and our students’ education are possible through our track-record of conservative budgeting and strong leadership,” Ivey said in a news release Monday.

Ivey has signed a record $12.1 billion education package, which includes $375 million for high-needs schools.

The governor also approved a $3.7 billion General Fund budget, which supports Medicaid, prisons, state troopers, courts and other non-education agencies. That’s up 10%, or about $350 million, from last year.

Education funding is up by 6% – the highest amount that the legislature can spend this year. The full $12.1 billion education package is made up of four buckets:

Alabama’s new school funding program, called the RAISE Act, will take effect this fall. The legislature plans to send $375 million to pre-pay the program for three years.

Under the program, school districts could get hundreds of dollars more per student, totaling as much as $11 million in additional funding, to support students with different learning needs.

By the 2025-26 school year, the RAISE Act would add:

  • $68 million for high-poverty schools, an increase of $37 million
  • $49 million in new funding for special education
  • $33 million for English learners, an increase of $17 million
  • $12 million for gifted students, an increase of $1.3 million
  • $1.2 million in new funding for charter schools

Education advocates and researchers said the investments would boost student outcomes – especially in poorly funded districts – while others called the session “one of the best on record” for teachers and other education workers.

The state Board of Education recently approved a $32,500 raise for the state superintendent, Eric Mackey.

Teachers will not get a raise this year, but many education employees will now be eligible for workers’ compensation and parental leave benefits. Lawmakers also are covering recent rate increases to PEEHIP, the health insurance program, so educators don’t have to front those costs.

“When we started this session, if someone would have told me that we would have PEEHIP fully funded, parental leave and a new workers’ comp program for Alabama educators, I would have never thought it was possible,” Amy Marlowe, president of the Alabama Education Association, told AL.com after the House passed the education budget.

UAB basketball adds former Northern Illinois guard via NCAA transfer portal

UAB announced the signing of former Northern Illinois guard Quaran McPherson on Monday, adding to a list of offseason signees for head coach Andy Kennedy and company,

McPherson played in 23 games last season for Northern Illinois with 12 starts, averaging 12.1 points and 5 rebounds a game for the Huskies.

He shot 92-for-202 (45.5%) from the field and 32-for-82 (39%) from beyond the arc, scoring a season-high 25 points against East-West University.

“Excited to have Q join our program,” Kennedy said in a release. “He is an experienced, hard nosed guard who plays with determination from the back court. His ability to shoot the 3 coupled with his downhill mentality will add great value to our team next season.”

In the 2023-24 season, he played in 13 games and averaged 4.6 points per game across 157 minutes on the court.

A graduate of Woodstock (Conn.) Academy, he averaged 14.6 points, 7 rebounds, 3 assists and 1.2 rebounds a game as a senior and signed with Nebraska out of high school.

He did not see any action for the Huskers, redshirting his freshman season and missing the 2022-23 season due to injury.

112 layoffs coming in another Alabama plant closure

A plastics manufacturer says it is closing its facility near Auburn.

Berry Global – now called Amcor, after a recent merger – is laying off 112 employees, according to a recent notice filed with the state.

The Indiana-based company is closing its facility in Lanett on July 1, a spokesperson said in an email to AL.com.

“Production will be integrated into existing facilities,” the spokesperson said. “We are grateful for our Lanett employees’ service and dedication and will assist them in exploring other opportunities within our organization and the Lanett community.”

The company said it announced the closure on April 29.

The next day, Amcor, a German health care packaging company, completed its $8.4 billion merger with Berry Global.

An Amcor spokesperson blamed the closure on “changing market conditions.”

The company has more than 240 facilities around the world, including one other Alabama manufacturing facility, in Montgomery.

Federal law requires large employers to file a public WARN notice with the state in advance of mass layoffs or plant closures. Those WARN notices are published by the Alabama Department of Commerce.

The expected job cuts bring Alabama’s tally of employees impacted by mass layoffs and closures in 2025 to more than 2,500 – already surpassing the count for last year.

In the last few months, Grede LLC announced plans to shut down operations at its Alabama manufacturing plant after 50 years, laying off 220 employees. Steel producer Nucor Buildings Group closed its plant in Eufaula, laying off 79 workers and sending the production to Texas. And AlaTrade Foods reportedly laid off 165 workers at its poultry processing plant in Phenix City.

Potential Diddy jurors asked if they are familiar with nearly 200 different celebrities

Jury selection for Sean “Diddy” Combs’ sex trafficking trial began Monday morning in New York as a media circus surrounded the courthouse in Lower Manhattan.

One hundred and fifty potential jurors were asked to fill out a questionnaire that gauged their knowledge of Combs, their views on law enforcement, whether they have experienced a sexual assault and more.

They were also given a list of at least 190 celebrities and public figures and asked to indicate which names they recognized.

Among the names on that list are Michael B. Jordan, Kanye West, Mike Myers and Kid Cudi. It’s unclear how the names on the list relate to the Combs trial, if at all. Combs is known to have hosted big Hollywood parties and was well-connected among celebrities.

Prosecutors believe that Kid Cudi, for one, is the victim of a car bombing committed by Combs in 2011. During that time, the “Pursuit of Happiness” rapper was romantically involved with Combs’ longtime ex-girlfriend, Casandra “Cassie” Ventura, the star witness of the federal trial.

A source familiar with the case indicates to Variety that Jordan will not be a witness. The “Sinners” actor went on a date with Ventura in 2015 and Combs was said to be upset about it.

Other names listed include Destiny’s Child singer Michelle Williams, actor Lauren London, singer Dawn Richard, singer-producer Dallas Austin and many of Combs’ family members. A surprising number of potential jurors indicated that they were not familiar with any of the names.

The jurors were given the option to discuss sensitive or personal questions in a private sidebar with just the judge, court reporter and two attorneys from each party.

Combs’ trial is expected to last at least eight weeks. Jury selection will take place until May 12, which is when opening arguments will likely occur.

Combs is facing five counts, including one for racketeering, two for sex trafficking and two for transportation to engage in prostitution. If he is convicted on any or all counts, Combs could spend the rest of his life in prison.

Since 2023, the music mogul has been hit with more than 70 civil lawsuits accusing him of sexual misconduct ranging from rape to sex trafficking. Those lawsuits are separate from the federal trial, which will likely feature testimony from high-profile figures such Ventura and other alleged victims whose names have yet to be revealed.

Federal prosecutors say they have interviewed more than 50 witnesses and recovered evidence from over 100 laptops, cellphones and other electronic devices that paint Combs as a serial abuser who led a vast criminal network held together by assistants, security guards and other employees who kept quiet for years. The charges in the indictment stem from alleged crimes that span from 2004 to 2024. Combs has denied all allegations and has insisted that all sexual activities were consensual.
