Capital murder arrest made after 5-year-old, mother and her boyfriend gunned down in car in Birmingham

A suspect has been charged in the Birmingham slaying of a mother, her young son and her boyfriend.

Jaccorian Deshawn McGregor, 25, is charged with capital murder of two or more people in the July killings of Arkia “Kia” Berry, 28, her 5-year-old son, Landyn Brooks, and her boyfriend, 28-year-old Eric Ashley Jr., Birmingham police announced Wednesday night.

The trio was gunned down July 13, 2024, inside a vehicle at the entrance of Echo Highlands Park.

“My babies can finally get some rest now,’’ said Titnisha Berry, mother of Arkia and grandmother of Landyn. “This won’t bring them back, but they can rest now. And I can have peace now.”

The police department’s Crime Reduction Team, U.S. Marshals and the Alabama Bureau of Pardons and Paroles took McGregor into custody Tuesday in the 900 block of Von Dale Lane.

McGregor was booked into the Jefferson County Jail at 6:20 p.m. Wednesday and remains held without bond.

He is also charged with failure to appear on outstanding 2024 charges of receiving stolen property and carrying a pistol without a license.

Additionally, court records show McGregor pleaded guilty in 2021 to receiving stolen property. He was sentenced to 20 years in prison with three to serve.

It was about 5:30 p.m. that Saturday when Birmingham police initially received a 911 call about a wreck.

When officers arrived, they found a sedan in front of a house next to the park.

It appeared to have jumped a curb and come to a stop. The car was riddled with bullet holes and three victims were found dead inside.

Witnesses told police they believe the shooter or shooters fled in another vehicle. The majority of the shell casings were in the parking area of the park.

A motive in the case has not been disclosed but police said the shooting was targeted.

The victims were among seven people killed in the city in roughly six hours that Saturday.

Later that night, shortly after 11 p.m., a drive-by shooting at a birthday party on the city’s northside left four people dead and 10 others wounded. Damien McDaniel, 22, and Hatarious Woods, 27, are charged with capital murder in that mass shooting.

Following the deaths of Berry, Landyn and Ashley, Birmingham Mayor Randall Woodfin posted this on social media:

“I really want to implore those dating people in the game to not ride with them. Don’t be in the same car. Don’t allow your children to ride with them. Don’t say yes when they say come with me or take me to make this lick.”

“It’s always supposed to be “no women, no children” but y’all don’t have a code. Too many of y’all are down with killing women and children. The only thing worse than that are the people who are giving safe harbor for those who kill women and children.”

Berry was a hair stylist, and Landyn was about to begin kindergarten.

“Landyn and Kia were two peas in a pod,’’ Berry’s cousin, Aniyah Berry, previously told AL.com. “Everywhere Kia went, Landyn was there.”

“She loved her baby so much,’’ Aniyah Berry said. “Everything he wanted, he had. Everything he needed, he had.”

Berry was a graduate of A.H. Parker High School. After graduation, she attended cosmetology school and became a licensed hair stylist.

“Ever since we were young, she was doing hair,’’ Aniyah Berry said. “She was passionate about hair.”

Berry was raising Landyn as a single mother after Landyn’s father, 27-year-old Ladarrius Jamiel Brooks, was found shot to death inside a burning Birmingham apartment in 2020.

Landyn was much-loved, outgoing and bright.

“He was so smart,’’ Aniyah said. “Landyn would tell you something you didn’t even know.”

“He was an old soul,’’ she said. “He lit up the room everywhere he went.”

Two days after the slayings, a vigil was held at Wahouma Park where Landyn played football on the 5U team. His coaches were emotional as they talked about him that day.

“He was a pot of gold,’’ said Darrius “Coach Traffic” Thomas. “He was the one player that lifted the kids up. He brought that spark.”
