A Jackson County woman who served jail time for killing a man accused of raping her is now back in jail after authorities say she violated her parole during drug rehabilitation.

Brittany Joyce Smith, 35, was taken into custody at Jackson County Jail last Thursday to serve a 15-day probation violation sentence for failing to complete a drug rehabilitation program.

According to court documents, Smith was discharged from drug rehab for possessing a cell phone and “fraternizing with a male in the program.”

Smith had requested to enter rehab. She was released from the Alabama Department of Corrections on Dec. 12 last year.

She is scheduled to enroll in a new rehab program on Friday, documents say.

Smith pleaded guilty on the eve of her scheduled trial to killing Todd Smith, no relation, in the kitchen of her home in Stevenson on the morning of Jan. 16, 2018 — just hours after Brittany said Todd raped and strangled her.

If Smith had been convicted at trial, she would have faced up to life in prison.
