Construction of the nearly $50 million amphitheater in downtown Birmingham will go on planned after a Jefferson County judge today dismissed a lawsuit seeking to halt the project.

Judge Tamara Harris Johnson said she had no choice but to dismiss the lawsuit because the Black Contractors Association of Alabama did not have standing to sue.
