Alec Baldwin to be charged with involuntary manslaughter in Halyna Hutchins shooting on ‘Rust’ set
Prosecutors announced Thursday that actor Alec Baldwin will be charged with involuntary manslaughter in the fatal shooting of a cinematographer who was killed on a New Mexico movie set.
Halyna Hutchins died shortly after being shot during rehearsals at a ranch on the outskirts of Santa Fe on Oct. 21, 2021. Baldwin was pointing a pistol at Hutchins when the gun went off, killing her and wounding the director, Joel Souza.
“We want to thank the Santa Fe Sheriff and the District Attorney for concluding their thorough investigation and determining that charges for involuntary manslaughter are warranted for the killing of Halyna Hutchins with conscious disregard for human life,” Brian Panish, the Hutchins family attorney, told TMZ.
“Our independent investigation also supports charges are warranted. It is comfort to the family that, in New Mexico, no one is above the law. We support the charges.”
Per The Wall Street Journal, the film’s armorer overseeing weapons, Hannah Gutierrez Reed, will also be charged with involuntary manslaughter in the incident, according to a statement from Santa Fe-area District Attorney Mary Carmack-Altwies.
The film’s first assistant director, David Halls, has agreed to plead guilty to the charge of negligent use of a deadly weapon.
Gutierrez Reed loaded the weapon, a Colt .45 revolver, according to investigators. The Associated Press reports Reed has said she did not put a live round in the gun that killed Hutchins, and believes she was the victim of sabotage, according to her attorney.
Santa Fe County Sheriff Adan Mendoza, who led the initial investigation into Hutchins’ death, described “a degree of neglect” on the film set. But he left decisions about potential criminal charges to prosecutors after delivering the results of a yearlong investigation in October. That report did not specify how live ammunition wound up on the film set.
Baldwin — known for his roles in “30 Rock” and “The Hunt for Red October” and his impression of former President Donald Trump on “Saturday Night Live” — has described the killing as a “tragic accident.”
He sought to clear his name by suing people involved in handling and supplying the loaded gun that was handed to him on the set. Baldwin, also a co-producer on “Rust,” said he was told the gun was safe.
In his lawsuit, Baldwin said that while working on camera angles with Hutchins during rehearsal for a scene, he pointed the gun in her direction and pulled back and released the hammer of the weapon, which discharged.
New Mexico’s Office of the Medical Investigator determined the shooting was an accident following the completion of an autopsy and a review of law enforcement reports.
In December of 2021, Alec Baldwin told ABC’s George Stephanopoulos in an interview that he did not pull the trigger on the gun.
“I didn’t pull the trigger,” Baldwin said. “I would never point a gun at anyone and pull the trigger at them. Never.”
It was Baldwin’s first sitdown interview since the Oct. 21 shooting.” Authorities have said Baldwin was told the gun was safe to handle but continue to investigate how a live round ended up in the weapon.
A wrongful death lawsuit was filed against Alec Baldwin and other key members of the production on Feb. 15, 2022.
The lawsuit named Baldwin and others who “are responsible for the safety on the set” and called out “reckless behavior and cost-cutting” that led to the death of Hutchins, according to the family’s lawyer.
