Alabama jury awards $1.9 million verdict against Dollar General
A Mobile County jury Wednesday awarded a $1.9 million verdict against Dollar General subsidiary Dolgencorp after determining the retailer did not properly maintain a backdoor delivery ramp.
The case, filed in 2020, stems from an April 20, 2019 incident at a Dollar General store on University Avenue in Mobile.
According to the suit, delivery driver Joseph Agee was operating a half-ton rolling cart containing cases of bottled water on a delivery ramp.
The suit stated that the store placed the metal ramp between the ground and the store entrance.
As the cart was being rolled over it, the ramp gave way on deteriorated gravel, causing Agee to fall. As a result, Agee suffered a torn rotator cuff, a broken toe, and other permanent injures that requiring two surgeries and left him needing intense physical therapy, his lawyers said.
Attempts to contact Dollar General for comment were not immediately successful.
The case was tried by attorneys Brad Kittrell and Michael Fondren of Andy Citrin Injury Attorneys.
