Prichard murder suspect’s case dismissed after detective misses preliminary hearing
A Prichard man charged with murder in connection with a homicide in the city had his case thrown out by a Mobile County judge Tuesday after a detective failed to show up during the preliminary hearing.
However, Kendarius Welch, 28, remains in the Mobile County Metro Jail on a hold for the state Department of Corrections, jail records showed. Welch was also charged with four probation violations at the time of his arrest.
Welch and another man, Nicholas Elias Mixon of Mobile, were charged with murder in the April 2 death of Dontavious Williams.
Welch’s preliminary hearing was conducted over several days.
Prichard police Det. Jason Hadaway, a witness in the case, showed up to one of the hearing days but did not appear for Tuesday’s session, according to the order dismissing the case by Mobile County District Court Judge Spiro Cheriogotis.
“Defendant appeared in Court from jail for preliminary hearing with attorney Jerome Carter. Detective Jason Hadaway not in Court. Case is dismissed at Defendant’s request …,” Cheriogotis wrote in his order.
Last week, Mixon’s bond was set at $75,000 by Cheriogotis. Mixon was also ordered to be placed under house arrest, court records showed.
