Bond denied for 2 Mississippi men charged in I-459 Hoover street race that ended in friend’s death
Two Mississippi charged with reckless murder in a deadly street-racing crash on Interstate 459 in Hoover have been denied bond following an Aniah’s Law hearing.
Tyrique M. Carter, 22, of Byram, Miss., and Elisha Jamal Lindsey, 22, of Jackson, Miss., were initially charged with reckless murder in the Feb. 9 death of Tamarion Burton of Jackson, Miss. The fatality victim was their friend.
They are also charged with attempting to elude, receiving stolen property and motor vehicle speed contest, a law enacted in Alabama in 2023 to crack down on street racing and exhibition driving.
Additionally, Carter is charged with leaving the scene of an accident with injuries or death.
The suspects were in stolen high-dollar vehicles at the time of the fatal crash.
Both men appeared Tuesday before Bessemer Cutoff Jefferson County District Judge Thomas E. Thrash Sr. The bond hearing also served as a preliminary hearing.
Thrash, in his Wednesday order denying bond, noted that Carter has four pending felony cases in Mississippi and is not a resident of Alabama. He also has outstanding warrants in other, unnamed, jurisdictions.
A Hoover investigator, in his testimony, attributed the direct cause of the accident – contact with the vehicle driven by the fatality victim – to Carter, the judge wrote.
Carter was driving a stolen 2023 BMW 2 worth $79,899 at the time of the crash.
“This court is uncertain that release in this case would be consistent with public safety,’’ Thrash wrote.
Lindsey, who also isn’t an Alabama resident, has three pending felony cases in Mississippi, and the judge noted that he has six counts of failure to appear in court on other cases.
The investigator testified that Lindsey’s “speed and reckless” behavior in handling the vehicle he was driving attributed to the wreck. Lindsey was driving a stolen 2020 Jeep Grand Cherokee Trackhawk worth $97,460.51.
In addition to denying bond, Thrash forwarded the cases to a grand jury for indictment consideration.
Charging documents state they were involved in an “exhibition of speed” and a “speed contest” at the time of the deadly crash.
Authorities said those involved were traveling together in a group in three vehicles. They were on their way to Mississippi from Atlanta.
The crash happened at 10:09 a.m. Friday, Feb. 9, on I-459 southbound near U.S. 31. Hoover, police Lt. Daniel Lowe at the time said all three vehicles were occupied by indivdiuals who knew each other.
They were each traveling at a very high rate of speed together on I-459 when the BMW and Nissan Sentra collided with one another, sending the Nissan Sentra off the roadway and into a tree.
The BMW and Jeep Grand Cherokee both briefly stopped but fled the scene when police arrived, resulting in the pursuit.
Burton was pronounced dead on the scene. Another person inside the car – Kortlon Talton – was taken to the hospital with serious injuries that required surgery, according to court records.
Descriptions of all the involved vehicles were provided by 911 callers and was shared with patrol officers in Hoover and neighboring agencies, Lowe said.
A short time later, a Hoover officer spotted the other two vehicles believed to be involved traveling on John Hawkins Parkway near Hunter Street.
The officer attempted to stop the vehicles, but both fled.
One of the vehicles, the Jeep Grand Cherokee driven by Lindsey, was involved in a single vehicle crash at the intersection of Highway 31 and I-459. He was taken into custody at that location.
Carter, in the BMW, continued fleeing and was pursued by officers with several area agencies, including Star 1 helicopter.
That vehicle eventually stopped at a gas station on Morgan Road in Helena where Carter was taken into custody.
Both suspects remain in the Jefferson County Jail.
