Suspect indicted in 2023 ambush killing in Birmingham that police say was fueled by retaliation

The suspect in the 2023 ambush shooting death of a 25-year-old man at a Birmingham gas station has now been indicted.

A Jefferson County grand jury indicted 52-year-old Byron Dedric Steele on capital murder in the slaying of Demetrius Antwan Davis Jr. He is also charged with certain persons forbidden to possess a firearm.

The indictments were issued Feb. 9, and made public Monday.

Police at the time of Davis’s death said the deadly shooting was carried out in retaliation for a previous incident in which a family member of Steele was shot.

Davis Jr. was gunned down March 26, 2023, at the Circle K on Tallapoosa Street while he was pumping gas.His death came nearly five years after his father was killed at a gas station on the city’s west side, which also happened on a Sunday.

Police said they were dispatched to the business at 6 p.m. Sunday on a report of a person shot. They arrived on the scene to find Davis Jr. dead in the parking lot.

The suspect, authorities said, approached the victim and opened fire. The victim’s vehicle was parked at a gas pump with the gas nozzle still in his tank.

Police at the time said it appeared Davis returned fire before he collapsed.

Steele is prohibited from possessing a firearm from a previous domestic violence conviction.

He has been held without bond in the Jefferson County Jail since his initial arrest on March 28, 2023.

A trial date has not yet been announced.
