Nick Saban’s daughter Kristen gets ‘Roll Tide’ from baby ‘who wouldn’t be here without’ IVF

In the wake of the Alabama Supreme Court ruling determining that frozen embryos are children under state law, the daughter of former Alabama football coach Nick Saban joined in on an Instagram trend showcasing babies born through in vitro fertilization.

“Alabama: tap in with the baby who wouldn’t be here without fertility treatment” the Instagram template reads.

On Friday, Kristen Saban Setas used the template to share a video of a boy clutching a football before he spikes it on the floor and shouting “Roll Tide!”

Though the child is not identified by name, it appears to be her son. Saban Setas gave birth to her first child, James Nickolas Setas, in 2020.

In an 8-1 ruling on Friday, the Alabama Supreme Court said three couples could sue a Mobile fertility clinic and Mobile Infirmary Medical Center for wrongful death after a wandering patient dropped frozen embryos.

The state’s highest court reversed a Mobile County judge’s decision finding that embryos are not people and to dismissing the wrongful death lawsuits.

Both the Mobile-based Center for Reproductive Medicine and Mobile Infirmary paused IVF treatments in wake of the ruling, along with UAB Hospital, which cited fears of prosecution.

While Alabama Attorney General Steve Marshall said the state “has no intention” of prosecuting IVF providers or families that use IVF treatments, those entities are still open to civil liability following the court’s ruling.

The ruling has attracted national attention.

Former President Donald Trump urged Alabama lawmakers to preserve in vitro fertilization. President Joe Biden said the ruling was a direct result of the U.S. Supreme Court decision to overturn Roe v. Wade.
