Suspect indicted for capital murder in 2023 shooting death of Birmingham engineer

A suspect has been indicted in the 2023 shooting death of a man in the parking lot of a south Birmingham apartment complex.

Samuel Edward Wiggins IV, 27, was initially arrested on the capital murder warrant on Oct. 2. A Jefferson County grand jury on Dec. 7 indicted Wiggins, and that indictment was made public this week.

Wiggins is charged in the slaying of 29-year-old Thomas Bostany.

The city’s South Precinct officers responded at 4:12 p.m. Saturday, Sept. 30, to a report of a person down in the 1000 block of Penthouse Drive, which is Mountainside Apartments.

When officers got to the location, they found Bostany unresponsive inside a vehicle. Birmingham Fire and Rescue Service pronounced him dead on the scene.

Wiggins was taken into custody at the apartment complex.

The charge is capital murder because the victim was in a vehicle when he was shot. A motive has not yet been public released.

Bostany a graduate of Spain Park High School and then UAB, where he received a degree in mechanical engineering. He also served as a graduate teaching assistant at UAB for more than two years, according to his obituary.

He was a full-time Research & Development Technician with voestalpine Railway Systems Nortrak and worked with R&D engineers throughout the company in North America and Austria in support of rail systems in North America.

“He was an accomplished athlete and extraordinary outdoorsman. You could find him in the outdoors fishing, boating, climbing, snowboarding, skateboarding, and camping. Tommy was passionate about wrestling,’’ the obituary read. “During his 4-year wrestling career at Spain Park HS, Tommy was a finalist at the State Wrestling Championships and placed each of his four years. In addition, Tommy continues to hold Spain Park school records from the 2011-2012 season for Most Wins (189), Most Pins (92) and Most Tech Falls (20). Tommy was recruited and signed to wrestle for University of Maryland.”
