19-year-old charged with capital murder in Hueytown drive-by shooting that killed innocent teen bystander

A 19-year-old has been charged in the October slaying of another teen in Hueytown.

Kevin Lee Whitley, of Quinton, is charged with capital murder in the shooting death of 17-year-old Frederick Lamar Harvey, who was an innocent bystander.

Harvey was killed in a drive-by shooting on Oct. 27. Authorities said the shooting happened at 2:15 a.m. Saturday in the 1000 block of 27th Avenue.

Harvey was in the back seat of a vehicle when someone opened fire. He was pronounced dead on the scene at 2:26 a.m.

Whitley, who raps under the name BaBy Diabo, is also charged with attempted murder. There were others in the car who were not injured.

Hueytown police Lt. Michael Shupe said during the course of the homicide investigation, detectives were able to connect Whitley to another shooting that happened on Jan. 15 in the 400 block of Murphy’s Lane.

No one was injured in the January shooting. He is charged with shooting into an unoccupied dwelling and shooting in that incident.

Authorities said the two crimes were linked.

The investigation is ongoing, and others could be charged.

Whitley will be held without bond once he is booked into the Jefferson County Jail.

“I am very proud of the resilient efforts of our detectives who have worked on this case nonstop since the night it happened,’’ said Chief Mike Yarbrough. “I am proud of the fact that we were able to bring some closure to Fred’s family and most of all, we send the message that we will not tolerate senseless acts of violence and we will work diligently to bring those who do commit crimes to justice.”
