No ruling on immunity for Darius Miles in shooting death of Jamea Jonae Harris

A judge today delayed ruling on whether to grant immunity to former University of Alabama basketball player Darius Miles in the death of Birmingham mother Jamea Jonae Harris.

Miles claims he acted in self-defense the morning of Jan. 15, when 23-year-old Harris was shot to death, court records state.

The judge will decide the issue of immunity at a later date.

Miles “respectfully requests that the Court, upon hearing the evidence, find (him) immune from prosecution” and the case against him dismissed, a filing from his attorney, Mary Turner, stated.

His co-defendant, Michael ‘Buzz’ Davis, has sought youthful offender status. A judge in July denied that request.

Miles was denied bond in May by Tuscaloosa County Circuit Judge Daniel Pruet, who said the issue of bond will be revisited at a later date.

The state of Alabama will not seek the death penalty in the case, according to a notice filed by the prosecution on Monday.

The filing noted the range of punishment if Miles is convicted on the charge is life in prison without the possibility of parole.
