Mistrial declared in capital murder case: Sleeping victim, 58, killed on couch in Birmingham home
The capital murder trial of a man accused of fatally shooting another man while he was asleep on the couch of a northern Birmingham home has ended in a mistrial.
Trevyion Brown, 24, is one of two suspects charged in the 2019 slaying of 58-year-old William Morris.
The deadly shooting happened about 2 a.m. April 22, 2019, in the 4200 block of Fairmont Way.
Morris was asleep on his cousin’s couch when at least 10 shots were fined into the home.
Also charged is Michael Lamont Shivers, 23. He was arrested in 2021 after two years on the run.
Shivers’ trial is set for March 2024.
Brown’s trial began Monday, July 31, in the courtroom of Jefferson County Circuit Judge Shanta Craig Owens.
Jurors began deliberations Thursday afternoon and deliberated all day Friday.
They returned to court Monday and, after further deliberations, told the judge they could not reach a consensus on a verdict.
Owens declared a mistrial and set a new trial date for Nov. 27.
There were five people asleep in the modest home in the Fairmont neighborhood when the shots rang out that morning.
After the gunfire ended, Morris was found dead.
Robert Chandler, Morris’ cousin and the owner of the home, said Morris had a good heart.
“He’d cook for you. He’d buy you food. He’d make you laugh,’’ he told AL.com in an interview hours after the killing. “He was a hard worker.”
Sonya Cook, a niece of Morris, gave a similar description of Morris’ character.
“He was a good person,’’ she said.
“He’d give you the clothes off his back. He wasn’t doing nothing except trying to get some sleep.”
Chandler said he was home at the time of the shooting.
“I jumped on the floor. I didn’t know where the bullets were coming from,” he said. “I opened the bedroom door and told (another resident) to call 911. I smelled the shots, the gunpowder.”
Chandler, 57, was found slain inside the same home in January of this year.
Authorities said he was killed during a robbery.
Tanarence Murphy, 27, and Aaron Elijah Bearden, 24, are charged with capital murder in Chandler’s slaying.
