Suspect in rape at Prichard motel previously got probation for rape at nightclub
A Mobile man who was given two years probation after pleading guilty to raping a Prichard nightclub employee in 2001 is now accused of raping and assaulting a woman at a Prichard motel last Saturday.
According to Prichard police, 46-year-old Willie Henry Ervin forced his way into the victim’s room at the Star Motel, pistol-whipped her and sexually assaulted her.
The victim later identified Ervin in a photo lineup, police said. He was arrested Thursday and charged with first-degree rape, first-degree sodomy, second-degree assault and first-degree burglary. He is being held without bond in the Mobile Metro Jail pending an initial court appearance set for Friday morning.
Court records show Ervin was charged in 2001 with first-degree rape from a July 2000 assault of an employee at the now-defunct Harlem Duke Night Club in Prichard. Through a plea agreement with the Mobile District Attorney’s Office, Ervin pleaded guilty to the lesser charge of 3rd-degree rape and was sentenced to one year in state prison.
However, the judge suspended the sentence, instead placing Ervin on two years probation — after which, provided he met the conditions of his probation — the jail sentence would be permanently suspended.
Mobile jail records show Ervin has been arrested numerous times in the years since, including two arrests for assault and one domestic violence charge.
