Birmingham father charged after shots fired into Vestavia Hills apartment, infant daughter kidnapped, police say
A Birmingham man is facing numerous charges after police say he kidnapped his infant daughter after firing shots into the baby’s mother’s Vestavia Hills apartment earlier this week.
Joel Bennett McCandless, 27, is charged with first-degree kidnapping, first-degree burglary, shooting into an occupied building, certain person prohibited from possessing a firearm, reckless endangerment, second-degree criminal mischief, violation of a protection from abuse order and interference with a domestic violence emergency call.
Vestavia Hills police Lt. Mike Keller announced the charges Tuesday afternoon.
Police responded at 6:20 p.m. Sunday to Grand Highland of Vestavia Hills apartment complex on Overton Road on a report of a possible kidnapping with shots fired.
Once officers arrived, they determined that McCandless – who does not have custody of the child – shot into the apartment before entering and taking the child, police said.
The 11-month-old girl was recovered a short time later in the Crestwood area of Birmingham.
McCandless was taken into custody Sunday night and was held in the Vestavia Hills City Jail until warrants were obtained on Tuesday. He is being transferred to the Jefferson County Jail where he will be held without bond.
Court records show the child’s mother in June successfully filed for a protection from abuse order against McCandless, claiming he had been emotionally, verbally, and physically abusive.
“He’s also stated he would kill me if we got into a serious altercation,’’ the mother wrote.
“You won’t be the one walking away,’’ she said he told her.
