Spring break shooting death of Birmingham teen ruled justified

The spring break shooting death of a 17-year-old Birmingham student has been ruled justifiable.

Authorities are Friday announced the Jefferson County District Attorney’s Office said no criminal charges will be filed in the March 26 slaying of Caleb Witt.

Caleb was a senior at Jackson-Olin High School and was about to become a father.

Birmingham police Chief Scott Thurmond previously said Caleb was with a group of people that was shooting into a home and some individuals returned fire, striking the teen.

“There again, we have a 17-year-old engaging in illegal activity, possessing a firearm, and he lost his life,’’ Thurmond said earlier this year.

“This could have been prevented had Mr. Witt not been engaging in that type of activity.”

Of Birmingham’s 55 homicides this year, four have now been ruled justified, and a fifth was an officer-involved shooting involving an outside law enforcement agency.

Birmingham police responded shortly before 12:30 p.m. that Sunday to University Crossings apartments, formerly known as Montevallo Gardens, in the Titusville community after Shot Spotter indicated multiple shots fired.

They found Witt unresponsive in the back parking lot of the complex. He was pronounced dead on the scene.

Officer Truman Fitzgerald said Shot Spotter registered at least 50 rounds fired in the following locations: 400 block of Gamma Street, 300 block of Iota Avenue, 200 block of Powell Avenue, Center Place South, First Avenue South and First Avenue S.W.

Those areas are all less than a mile away from where Caleb was found dead, which is the 200 block of Third Avenue S.W.

Fitzgerald had said investigators believe there was a shootout between two groups about a half mile to a mile away.

“We feel the victim was struck by gunfire and dumped in the back of these apartments,” he said.

“Let me point out…the group that he was with instead of taking him to the hospital, they took him to a back parking lot and just dumped him out,’’ Fitzgerald said.

“That needs to be a message to the community of really look who you surround yourself with.”

Jackson-Olin High School Principal Nichole Davis-Williams in an earlier interview with AL.com said Caleb was charismatic and loved by everyone at Jackson-Olin.

“Despite what they say he did, Caleb was not that kid in my presence,’’ the principal said. “He was kind. He was loving. He was thoughtful.”

She said Caleb’s smile stood out. “All of the teachers loved him,” Davis-Williams said.

Caleb had missed about 20 days of school but was committed to making up that work and getting back on track.

“He said, ‘I really want to finish. Can you help me?’’’ Davis-Williams recalled.

Caleb was put into a program and was putting in the work.

“We had a plan so we could get him back on track and that’s what we were working on when he died,’’ she said.

“When you spend countless minutes and hours working on these plans and then someone just takes their life, it’s like, ‘How dare you?’’’
