Pelham construction company must pay $108,000 in overtime to 21 employees
A Pelham-based construction company must pay $108,127 in overtime wages to 21 of its employees, following action by the U.S. Department of Labor’s Wage and Hour Division.
An investigation found Timberline Construction Group wrongly classified the workers as exempt from overtime. Because of this, they were not paid the time-and-a-half overtime premium, which violated the Fair Labor Standards Act.
Timberline is a commercial construction company providing site development, directional drilling, manufactured housing, as well as disaster response and community housing services. The company employs more than 200 people in Florida, Louisiana, Missouri, North Carolina, Texas and West Virginia, as well as Alabama.
Wage and Hour Division District Director Wildalí De Jesús said Timberline reviewed its pay practices and agreed to comply.
“The (Wage and Hour) division encourages all employers to use this example to ensure compliance with the law,” De Jesús said.
