Alabama meteorologist returning to work after stalking charge leveled by waitress dismissed

A misdemeanor stalking charge against an Alabama meteorologist has been dismissed.

WDHN weekend meteorologist Andrew Clarke in January was arrested on the second-degree stalking charge. The charge against the 23-year-old Clarke was dropped Thursday morning.

Clarke’s attorney John C. White the case lacked merit.

“I said from Day 1 based on the materials that I read, a crime had not been committed,’’ White said. “And today, I believe the city prosecutor had an opportunity to speak with the victim and look over the statue and a case couldn’t be made.”

The alleged victim contended Clarke repeatedly showed up at the restaurant where she was a server, would request her table and then stay for hours. He also reportedly showed up in the parking lot of her apartment complex.

The two did not know each other and had never been in any kind of a relationship.

Under Alabama law, a person commits the crime of second-degree stalking if he or she, acting with an improper purpose, intentionally and repeatedly follows, harasses, telephones, or initiates communication, verbally, electronically, or otherwise, with another person, any member of the other person’s immediate family, or any third party with whom the other person is acquainted, and causes material harm to the mental or emotional health of the other person, or causes such person to reasonably fear that his/her employment, business, or career is threatened, and the perpetrator was previously informed to cease that conduct.

White said those elements couldn’t be proven beyond a reasonable doubt.
