Birmingham man faces new indictment in shooting death although he didn’t fire fatal shots
A 41-year-old has been indicted in the shooting deaths of two men that happened hours apart in Birmingham, even though he didn’t pull the trigger in one of the killings.
A Jefferson County grand jury indicted Brandon Quartez Jemison on two counts of murder, one count of felony murder and attempted murder. The indictments were issued Feb. 7 and made public Tuesday.
Jemison was initially only charged with felony murder in the Sept. 24, 2024, shooting death of Malike Williams. The grand jury, however, added an intentional murder charge, records show.
Jemison and Williams, who are believed to be related, were in a confrontation with a third man at Big Boy Convenience Store on Pearson Avenue.
Police previously said the third man fired the shots that killed Williams, and he was justified in defending himself because Williams was the aggressor.
However, under Alabama’s accomplice liability, Jemison was charged with the death of Williams. That law allows a person to be charged if they are participating in a felony crime that results in a death, whether or not that person actually pulled the trigger.
The indictment says Jemison caused the death of Williams by “participating in a gunfight” that caused the death of Williams, who died en route to the hospital.
Police at the time said the deadly shooting possibly stemmed from a dispute over a social media post.
Jemison fled the scene after Williams was shot.

Last month, Jemison was charged with murder in the shooting death of 34-year-old Damone Gardner, which happened hours after Williams’ killing. The grand jury returned a murder indictment in that case as well.
West Precinct officers responded to a Shot Spotter alert in the 300 block of 27th Street S.W. shortly before 8:30 p.m. that Tuesday.
They arrived to find Gardner unresponsive in the middle of the road. Birmingham Fire and Rescue Service pronounced him dead on the scene.
The gunfire detection system registered two shots fired.
Authorities said an argument took place between Gardner and Jemison, possibly linked to the shooting death of Williams – who was Gardner’s best friend.
Jemison was booked into the Jefferson County Jail on Nov. 22, 2024, and remains held.
