Man charged with sexually abusing child allegedly tells deputies: ‘It is what it is’

A Guatemalan man who is in the country illegally and is accused of sexually abusing a child less than 12 years old in north Alabama was placed on an immigration hold after being charged, authorities said Tuesday.

Limestone County sheriff’s deputies responded to a call Sunday of a suspect caught in the act of abusing a child less than 12 years old, said Sheriff Joshua McLaughlin.

A sheriff’s deputy on the scene learned the victim’s family detained the suspect after the suspect was caught in the act of sexually abusing the child until deputies could arrive, said McLaughlin.

The suspect was initially identified as Mario Francisco Martin but later confirmed to be Luis Lopez-Martinez, a 38-year-old Guatemalan national, the sheriff said.

The victim was taken to a local hospital for medical evaluation and care.

Lopez-Martinez allegedly confessed to the abuse, telling authorities “it is what is is,” the sheriff said.

The suspect was arrested and charged and held on $250,000 bond.

U.S. Immigration and Customs Enforcement (ICE) placed an immigration detainer on Lopez-Martinez, meaning ICE can take him into custody and/or deport him.

The investigation was ongoing as of Tuesday afternoon and additional charges may be filed in the case, according to the sheriff.
