Alabama Attorney General co-files US Supreme Court brief opposing transgender athletes
Alabama Attorney General Steve Marshall is continuing to challenge the legality of transgender women and girls competing in sports.
Marshall announced on Friday that he co-filed an amicus brief along with the Arkansas attorney general to the U.S. Supreme Court.
According to a press release, the brief asks the high court to review “a lower court’s decision that the Constitution prohibits States from restricting girls’ sports teams to biological females.”
In September, the Ninth Circuit Court of Appeals held that a 2022 Arizona law prohibiting trans-women and girls from playing sports that align with their gender identity likely violates the Equal Protection Clause.
The brief also had support from 22 other states including Alaska, Florida, Georgia, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, West Virginia, and Wyoming.
Marshall has also previously filed two similar briefs regarding laws in West Virginia and Idaho.
“Parents of daughters are rightfully outraged at the loss of positions on teams and college scholarships,” Marshall stated. “As our multiple briefs to the Supreme Court show, it’s time to return to fairness in opportunity for sports.”
Over the last few years, Alabama has signed into law restrictions against transgender athletes competing in sports that align with their gender identity in public schools and colleges.
Trans-rights organizations have argued that the emphasis on transgender athletes is part of a cultural strategy by conservatives that only further marginalizes a vulnerable population.
“Anti-trans sports bans risk further marginalizing young people who already face tremendous challenges in school,” according to the Human Rights Campaign.
“Proponents of these bans suggest that trans athletes are pretending to be trans in order to do well at sports – ignoring entirely the incredible stigma trans youth face.”
The Human Rights Campaign has also stated that the emphasis on trans-women and girls is a sexist argument as anti-trans sports bans often overlook trans-boys. The organization says this is because those who oppose trans athletes participating in sports don’t think trans-boys can compete with cisgender boys which is a sexist assumption.
