19-year-old arrested in Western Hills Mall shooting that killed innocent bystander, sheriff says

A suspect has been charged in the slaying of an innocent bystander caught in crossfire in the food court at Western Hills Mall in Fairfield.

Tavion Jermaine Perry, 19, is charged with murder in the Sunday shooting death of 32-year-old Darin Marquese Hall, Jefferson County sheriff’s officials announced Thursday.

He is also charged with attempted murder, said sheriff’s spokesman Henry Irby.

Perry is being held without bond in the Jefferson County Jai.

The shots rang out about 5 p.m. Sunday at the Fairfield mall, located on Aaron Aronov Drive.

Roughly a dozen people were in the food court when there was some type of confrontation between three people, according to video and witnesses.

One of them – believed to Perry – had his hand under his shirt and was on one side of the food court. Two other men were on the other side as they engaged in some sort of dispute.

As one of the two men moved closer to Perry, he pulled a gun and fired.

The man who approached him dropped to the ground before getting back up and stumbling, appearing to be injured. The other of the two men appears to have returned fire before running away.

Customers sitting at three nearby tables ducked for cover, two of them taking off running and a woman dropping to the floor.

Those in line also scattered, included Hall.

A Fairfield firefighter who was also picking up food put a towel under Hall’s shirt to apply pressure to his wound, according to video that was posted to social media but later removed.

Chief Deputy Coroner Bill Yates said Hall was pronounced dead at Princeton Baptist Medical Center at 5:33 p.m.

Sheriff’s spokesman Henry Irby said a 21-year-old man was taken to UAB Hospital with a gunshot wound. The extent of his injury was not immediately released.

“We offer our prayers and condolences to the family of Mr. Hall and praying for the injured person,‘’ Fairfield Mayor Eddie Penny previously said. “We encourage all to put the guns down and stop the killing in our neighborhoods.”

There have been other shootings at the Western Hills Mall in recent years.

In 2023, a 16-year-old boy was killed in hail of gunfire by three masked suspects outside the mall, police said at the time.

In 2020, a man was shot in the parking lot.

In 2018 a manager at the mall was shot and died on a sidewalk. The manager, 59-year-old Anthony Alberigi, was an innocent bystander who got caught in crossfire between two groups of young men, police said at the time.
